Our Chapter 13 Bankruptcy Practice

Only individuals can file under Chapter 13. A Chapter 13 filing reorganizes an individual's debts, and the individual repays certain debts in full or in part over a three to five year plan. If you don't qualify for protection under Chapter 7, or you prefer to repay your creditors over a three-to-five-year period, we will help you seek the protection of the bankruptcy laws under Chapter 13. We will prepare and file all documents required to complete the process, and will work with your creditors, the bankruptcy trustee and the court.

When you hire us to handle a Chapter 13 petition, we will carefully review your financial situation and work with you to put together a reorganization plan to submit to your creditors. We will also review any proposed repayment plans you receive, to make certain they are within your means. If you make promises in a Chapter 13 filing, but fail to live up to them, you can lose the protection afforded by the bankruptcy laws, and be subject to calls, letters or legal filings from your creditors.

Why file for Chapter 13? Many times, a Chapter 7 bankruptcy will not provide individuals with the relief they are seeking. A Chapter 13 may be able to help with:

  • Forcing payment arrangements on child support and other support obligations as well as taxes;
  • Retaining property that would have otherwise been liquidated
  • Discharging debts that are not dischargeable in a Chapter 7;
  • Modifying the rights of creditors, such as "Cram-Downs" and "Lien-Stripping"; and
  • Providing relief when it is too soon to file under Chapter 7
